I'm inclined to agree. I would also point out that ultimatly, one can
point at a lack of empathy as the source of "moral" evil, and that we
(society) attempt to *use* justice and equity to *enforce* empathy on those
who have neglected it. Perhaps not the wisest way to go, but I don't see
any *practical* alternatives. (the TCS philosophy of non-coersion only
works when both parties are committed to working things out to the benefit
of both parties -- such is obviously not the case in criminal justice)
